Terms of Service
Effective Date: February 4, 2026
1. Introduction and Acceptance
These Terms of Service ("Terms") govern your use of the MapBloom mobile application ("the App", "Service") operated by Jakub Różycki (sole proprietorship), located in Cracow, Poland ("we", "us", "our").
By downloading, installing, or using MapBloom, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
2. Eligibility
Age Requirements
- You must be at least 16 years old to use MapBloom independently in the European Union (or the applicable age of digital consent in your country).
- You must be at least 13 years old to use MapBloom in the United States and other jurisdictions.
- If you are under the applicable age, your parent or legal guardian must supervise your use of the App. By allowing a minor to use the App, the parent or guardian agrees to these Terms on the minor's behalf and accepts responsibility for the minor's use.
Verification: We may request verification of age or parental consent at any time. If we learn that we have collected personal information from a child without appropriate consent, we will delete that information promptly.
Minimal Data Collection: MapBloom does not require user accounts and minimizes data collection. See our Privacy Policy for details on what limited data we process.
By using the App, you represent and warrant that you meet these eligibility requirements.
3. Description of Service
MapBloom allows you to:
- Select any geographic area on a map
- Apply visual themes and styles to create map posters
- Add typography including city names and coordinates
- Export high-resolution images to your device or share them
The App uses map data from OpenStreetMap and mapping services from Apple MapKit. MapBloom processes your designs locally on your device.
Free and Pro Tiers: MapBloom offers core features for free, including map creation and export with a selection of themes. Additional themes and features are available through an optional one-time Pro purchase.
4. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, for personal or commercial purposes as permitted herein. This license is granted for the term of these Terms and automatically terminates upon any termination of your rights under these Terms.
You may not:
- Copy, modify, or distribute the App
- Reverse engineer, decompile, or disassemble the App
- Remove any copyright or proprietary notices
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to our systems or servers
- Use the App in violation of export control laws or sanctions
5. User Content
Your Ownership: You retain full ownership of the map posters and designs you create using MapBloom ("User Content"). We claim no ownership or license rights over your creations.
Your Freedom: You may use, share, sell, print, modify, or distribute your posters for any purpose, whether personal or commercial.
Local Processing: MapBloom processes your designs locally on your device. Your posters are not uploaded to our servers.
Third-Party Data: Your posters incorporate map data from OpenStreetMap (subject to ODbL license) and Apple MapKit. See Section 6 for attribution requirements when sharing or publishing your posters.
Your Responsibility: You represent that any custom text, names, or other elements you add to your posters do not infringe third-party rights or violate applicable laws.
6. OpenStreetMap Data and Attribution
Data Source: MapBloom uses map data from OpenStreetMap ("OSM"), a collaborative mapping project. OSM data is made available under the Open Database License (ODbL) v1.0.
How We Comply
- The App displays OSM attribution ("© OpenStreetMap contributors") on all map views
- Exported poster images include attribution in the image metadata
Your Obligations When Sharing Posters
When you share, publish, or sell posters created with MapBloom:
- Attribution Required: You must provide attribution to OpenStreetMap. The attribution embedded in exported images satisfies this requirement if kept intact.
- Commercial Use Permitted: You may sell posters created with MapBloom.
- No Removal: Do not remove or obscure the OpenStreetMap attribution from exported images.

7. Purchases and Payments
Free Features: MapBloom offers free features including map creation and export with a selection of themes.
Pro Plan: Additional premium themes and features are available for purchase through a one-time in-app purchase ("Pro Plan"). The Pro Plan is a perpetual license that does not expire and unlocks all Pro content available at the time of purchase, plus any future updates to existing Pro features.
Payment Processing: All purchases are processed through Apple's App Store. By making a purchase, you agree to Apple's terms and conditions for in-app purchases.
Refunds: Refund requests are handled by Apple according to their refund policies. We do not process refunds directly. To request a refund, contact Apple Support or visit reportaproblem.apple.com. We will cooperate with any legitimate refund request and will not contest valid consumer claims.
Price Changes: We reserve the right to change prices for the Pro Plan. We will provide at least 30 days' notice before any price increase takes effect. Price changes will not affect purchases already completed.
EU Consumer Rights - Right of Withdrawal
If you are a consumer in the European Union, you have the right to withdraw from a purchase within 14 days without giving any reason.
Exception for Digital Content: By making an in-app purchase, you expressly consent to immediate performance of the contract (immediate access to Pro features) and acknowledge that you thereby lose your right of withdrawal once the digital content has been fully provided. This consent is obtained through the App Store purchase flow.
Statutory Warranty: Notwithstanding the above, you retain all statutory warranty rights under applicable law, including remedies for digital content that does not conform to the contract.
8. Prohibited Conduct
You agree not to:
- Use the App to create content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
- Use the App to infringe on any third party's intellectual property rights
- Attempt to interfere with or disrupt the App's servers or infrastructure
- Use automated systems or software to extract data from the App
- Impersonate any person or entity
- Use the App in any manner that could damage, disable, or impair the Service
- Violate any applicable laws or regulations
- Use the App in violation of export control laws or sanctions
9. Third-Party Services
MapBloom integrates with third-party services that have their own terms and privacy policies:
Apple MapKit: Map display, place search, and reverse geocoding are provided by Apple. Your use of these features is subject to Apple's Terms of Service and Privacy Policy. Apple MapKit usage is subject to Apple's usage limits and terms.
OpenStreetMap: Map data is sourced from OpenStreetMap under the Open Database License. See openstreetmap.org/copyright.
We are not responsible for the practices or content of these third-party services. Your interactions with third-party services are governed by their respective terms.
10. Intellectual Property
Our IP: The App, including its design, features, graphics, and code (excluding User Content and third-party content), is owned by us and protected by copyright, trademark, and other intellectual property laws.
Trademarks: "MapBloom" and the MapBloom logo are our trademarks. You may not use our trademarks without prior written permission.
Feedback: If you provide suggestions, ideas, or feedback about the App, you grant us the right to use such feedback without any obligation to you.
11. Disclaimer of Warranties
We do not warrant that:
- The App will be uninterrupted, secure, or error-free
- Map data will be accurate, complete, or current
- The results obtained from using the App will meet your requirements
- Any errors in the App will be corrected
Map data is sourced from OpenStreetMap, a community-driven project. We do not guarantee the accuracy, completeness, or reliability of map data.
Consumer Rights
If you are a consumer, these disclaimers do not affect your statutory rights under applicable consumer protection laws, including:
- In the EU: Your rights under the Consumer Rights Directive and Digital Content Directive (EU) 2019/770, including remedies for digital content that does not conform to the contract
- In the UK: Your rights under the Consumer Rights Act 2015
- In Australia: Your rights under Australian Consumer Law
Nothing in these Terms excludes or limits our liability for matters which cannot be excluded or limited under applicable law.
12. Limitation of Liability
General Limitation: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, our total aggregate liability for any claims arising from these Terms or your use of the App shall not exceed the greater of: (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) €50.
Excluded Damages: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
Exceptions - We Do Not Limit Liability For
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Gross negligence or willful misconduct
- Any other liability that cannot be excluded or limited by applicable law
- Our obligations under applicable data protection laws
Consumer Rights: If you are a consumer, these limitations do not affect your statutory rights or any liability that cannot be excluded under the laws of your country of residence.
Basis of the Bargain: You acknowledge that we have set our prices and entered into these Terms in reliance upon the disclaimers and limitations of liability herein, which allocate risk between us and form an essential basis of the bargain between us.
13. Termination
By You: You may stop using the App at any time by uninstalling it from your device. No refund is due for the Pro Plan as it is a one-time perpetual license.
By Us for Cause: We may suspend or terminate your access to the App immediately if you:
- Materially breach these Terms
- Engage in conduct that is illegal or harmful to us or other users
- Use the App in a way that could expose us to legal liability
By Us for Convenience: We may discontinue the App entirely with 90 days' notice. If we discontinue the App within 12 months of your Pro Plan purchase, we will provide a pro-rata refund.
Effect of Termination
Upon termination:
- Your license to use the App ends immediately
- You may keep any posters you have already exported
- Sections 5, 10, 11, 12, 15, and 16 survive termination
No Liability: Subject to the refund provision above, we are not liable to you or any third party for any termination of your access to the App.
14. Changes to These Terms
Minor Changes: We may make minor changes to these Terms (such as correcting typos, clarifying language, or updating contact information) at any time by posting the revised Terms in the App.
Material Changes: For changes that materially affect your rights or obligations, we will:
- Provide at least 30 days' advance notice through the App
- Clearly describe what is changing
- Give you the opportunity to review the changes before they take effect
Your Choices
If you do not agree to material changes:
- You may stop using the App before the changes take effect
- If you have purchased the Pro Plan, material adverse changes will not apply to your existing purchase without your consent
Continued Use: Your continued use of the App after the effective date of any changes constitutes acceptance of the revised Terms for future use.
We will update the "Effective Date" at the top of this page when changes are made.
15. Governing Law and Dispute Resolution
Governing Law: These Terms are governed by the laws of Poland, without regard to conflict of law principles.
Jurisdiction: Subject to the consumer rights provisions below, disputes shall be resolved in the courts of Cracow, Poland.
EU Consumer Rights
If you are a consumer habitually resident in the European Union:
- You may bring proceedings in the courts of your country of residence
- Mandatory consumer protection laws of your country of residence apply regardless of the choice of Polish law
- You may also use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr
US Consumers: If you are a resident of the United States, you may bring claims in your state of residence to the extent required by applicable law.
Informal Resolution: Before filing any formal dispute, we encourage you to contact us at [email protected]. We will try to resolve your concern within 30 days.
16. California Privacy Rights
If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):
Your Rights
- Right to Know: You can request information about the personal information we collect, use, and disclose.
- Right to Delete: You can request deletion of your personal information, subject to certain exceptions.
- Right to Opt-Out: You have the right to opt out of the "sale" or "sharing" of your personal information.
- Right to Correct: You can request correction of inaccurate personal information.
- Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

17. Apple App Store Terms
If you downloaded MapBloom from the Apple App Store, you acknowledge and agree to the following:

| Acknowledgment | These Terms are between you and Jakub Różycki only, not with Apple Inc. Apple is not responsible for the App or its content. |
| Scope of License | The license granted to you is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the App Store Terms of Service. |
| Maintenance and Support | Jakub Różycki, not Apple, is responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support services. |
| Warranty | In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App. |
| Product Claims | Jakub Różycki, not Apple, is responsible for addressing any claims relating to the App or your use of it, including product liability claims, regulatory compliance claims, and consumer protection claims. |
| IP Claims | In the event of any third-party claim that the App or your use of the App infringes a third party's intellectual property rights, Jakub Różycki, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim. |
| Legal Compliance | You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a 'terrorist supporting' country, and you are not listed on any U.S. Government prohibited party list. |
| Third-Party Beneficiary | Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary. |
18. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Force Majeure: We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, internet or telecommunications failures, or pandemics.
Electronic Communications: You consent to receive communications from us electronically through the App.
19. Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy explains:
- What information we collect (minimal - see policy for details)
- How we use and protect your information
- Your rights regarding your personal data
- How to contact us about privacy concerns
By using MapBloom, you acknowledge that you have read and understood our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
